Poland: Accessibility Act enters into force for products and services (EAA transposition)
Date note: Ustawa z dnia 26 kwietnia 2024 r. o zapewnianiu spełniania wymagań dostępności przez niektóre podmioty gospodarcze (Polish Accessibility Act) transposes the EU Accessibility Act (EU) 2019/882; the Act's substantive requirements apply from 28 June 2025.
What changes
Since 28 June 2025, specified products (computers, smartphones, e-readers, self-service and payment terminals) and services (e-commerce, banking, telecoms, digital passenger transport, audiovisual media) placed on the Polish market must meet EU-aligned accessibility requirements so people with disabilities can use them independently. Micro-enterprises providing services are exempt, and product-trading micro-enterprises face reduced administrative obligations.
Who is affected
Small, medium and large companies producing, importing, distributing or offering in-scope products or services in Poland, especially e-commerce, banking, telecoms, transport and media; micro-enterprises providing services are exempt.

What to do
Check your products, websites and customer-facing services against the accessibility requirements (broadly WCAG-aligned for digital services). If relying on the micro-enterprise service exemption, keep evidence you qualify; if relying on the disproportionate-burden defence, document that assessment. Be ready to respond to a market-surveillance request from PFRON or your sector regulator (UKE for telecoms, the Financial Ombudsman for financial services).
Penalty
Progressive enforcement: first an order to take corrective action or withdraw the product/service from the market; for persistent non-compliance, a fine up to ten times the national average monthly salary, capped at 10% of the entrepreneur's turnover in the preceding financial year.
