From 1 January 2026, registered electronic delivery (e-Doręczenia) replaced ePUAP as the primary channel Polish public authorities use to correspond with businesses and citizens that hold an e-Doręczenia address. Correspondence sent to an entity's e-Doręczenia address has the same legal effect as registered mail; relying only on the old ePUAP inbox after the cutover can be legally ineffective for parties obligated to hold an e-Doręczenia address.

Poland: amended Cybersecurity Act (KSC) implementing NIS2 enters into force

The amendment to Poland's Act on the National Cybersecurity System (Ustawa o krajowym systemie cyberbezpieczeństwa, KSC), transposing the EU NIS2 Directive (EU) 2022/2555, was adopted by the Sejm on 23 January 2026, signed by the President on 19 February 2026, published in the Journal of Laws on 2 March 2026, and entered into force on 3 April 2026. It expands the categories of 'key' and 'important' entities subject to cybersecurity risk-management and incident-reporting duties.

Entgelttransparenz: Grundpflichten (Gehaltsspannen, Verbot von Fragen zur Gehaltshistorie, Recht auf Entgeltinformationen) gelten für jeden Arbeitgeber

Die Richtlinie (EU) 2023/970 verpflichtet jeden Arbeitgeber in der EU, unabhängig von seiner Größe, Bewerbern das Anfangsentgelt oder die Entgeltspanne für die Stelle vor dem Vorstellungsgespräch oder in der Stellenanzeige mitzuteilen, und verbietet Fragen nach der Gehaltshistorie der Bewerber. Beschäftigte erhalten zudem das Recht, schriftlich Auskunft über ihr eigenes Entgeltniveau und das durchschnittliche Entgeltniveau nach Geschlecht für Personen mit gleicher oder gleichwertiger Arbeit zu verlangen.

Abschaffung der 150-€-Zollbefreiungsschwelle: befristete Pauschalabgabe auf Kleinsendungen

Bis Mitte 2026 waren Sendungen im Wert von bis zu 150 €, die aus Nicht-EU-Ländern an EU-Verbraucher versandt wurden, zollfrei (Mehrwertsteuer fällt bereits seit 2021 an). Die Verordnung (EU) 2026/382 des Rates hat diese Befreiung aufgehoben und erhebt ab dem 1. Juli 2026 eine befristete Pauschalabgabe von 3 € pro Artikel auf solche Kleinsendungen, bis mit dem Betrieb des EU-Zolldatenhubs (angestrebt Mitte 2028) reguläre wertorientierte Zölle greifen.

Kosmetik: erweiterte Kennzeichnungspflicht für Duftstoffallergene (26 auf über 80) für neue Produkte verpflichtend

Die Liste der Duftstoffallergene, die in der Kosmetikverordnung einzeln auf dem Etikett genannt werden müssen, wächst von rund 26 auf über 80 Stoffe, sobald diese in Konzentrationen über 0,001 % in nicht abzuspülenden bzw. 0,01 % in abzuspülenden Produkten enthalten sind. Neue kosmetische Produkte, die ab dem 31. Juli 2026 in Verkehr gebracht werden, müssen die erweiterte Liste verwenden; bereits vor diesem Datum in Verkehr gebrachte Bestände dürfen noch bis zum 31. Juli 2028 verkauft werden.

Recht-auf-Reparatur-Richtlinie gilt: Hersteller müssen auf Verlangen reparieren; reparierte Waren erhalten 12 zusätzliche Garantiemonate

Die Richtlinie (EU) 2024/1799 gilt national ab dem 31. Juli 2026. Hersteller von Produkten mit EU-Reparierbarkeitsanforderungen (Waschmaschinen, Kühlschränke, Geschirrspüler, Staubsauger, Displays, Smartphones, Tablets, Server, E-Bike-Akkus) müssen diese zu einem angemessenen Preis und in angemessener Zeit reparieren, auch außerhalb der gesetzlichen Gewährleistung. Entscheidet sich ein Verbraucher innerhalb der Gewährleistung für eine Reparatur, verlängert sich die Gewährleistung um 12 Monate. Verkäufer müssen eine Reparatur anbieten, wenn diese nicht teurer ist als ein Ersatz.

Nutzer müssen darüber informiert werden, wenn sie mit einem KI-System interagieren (Chatbots, Sprachassistenten). KI-generierte oder manipulierte Bilder, Audio-, Video- und Textinhalte müssen maschinenlesbar gekennzeichnet werden, Deepfakes müssen als solche ausgewiesen werden. Ab demselben Datum können nationale Behörden Unternehmen für die meisten Verstöße gegen den AI Act mit Geldbußen belegen.

Verpackungsverordnung (PPWR): Kernpflichten gelten (Minimierung, PFAS-Verbot in Lebensmittelverpackungen, Konformitätsdokumentation, EPR-Registrierung)

'klimaneutral', 'umweltfreundlich', 'grün' ohne Beleg), verbietet Aussagen, die sich allein auf Emissionskompensation stützen, und verlangt, dass Nachhaltigkeitssiegel auf einem Zertifizierungssystem beruhen oder von Behörden eingerichtet wurden statt selbst erstellt zu sein. Zudem wird geplante Obsoleszenz verboten und klarere Informationen zu Haltbarkeit und Reparierbarkeit von Produkten verlangt.

Die Richtlinie (EU) 2024/2831 muss bis zum 2. Dezember 2026 umgesetzt werden.
